39-year-old man docked over alleged murder

One Lucky Jerry, 39, was Wednesday, remanded in prison custody by an Evboriaria Magistrates’ Court in Benin over the alleged murder of one Aimuamwosa Otabor.

The Prosecutor, ASP Aigbedion Obakpolor, said that the accused committed the offence on May 19, 2013, at 21, Amadasun St., off Uwa Street in Benin, alleging that the suspect, on the said day at about 8: 00 p.m, shot and killed Otabor with a single barrel gun.

The plea of the accused person was not taken on the two-count charge of conspiracy and murder.



According to the prosecutor, the offence contravened Sections 324 and 319 (1) of the Criminal Code, Cap. 48, Vol. 11, Laws of the defunct Bendel State of Nigeria, 1976, now applicable in Edo.

The Court Magistrate, Mr. F.O. Idiake, ordered that the accused be remanded in prison custody.

Idiake said the court lacked the jurisdiction to entertain the case.

He, however, ordered that the case file be sent to the Office of the Director of Public Prosecutions, for advice, and adjourned the case till December 30 for mention.
